    During the COVID-19 crisis, WH&S obligations continue to apply. Risk assessment and management should continue, with a focus on managing COVI-19 hygiene and distancing requirements. The primary duty remains in place, to ensure, so far as is reasonably practicable, that the health and safety of workers, clients, visitors, customers and volunteers in the workplace is not put at risk from the conduct of the business or undertaking.

    If an employee falls sick with COVID-19, then a claim may arise under worker’s compensation if the illness was contracted arising from or in the course of employment. If the employee is treated as an in-patient in hospital for any duration, then the incident may also need to be reported to SafeWork SA or WorkSafe NT.

    Casual Employees Potential Entitlement to Leave

    The Full Federal Court in the case of WorkPac Pty Ltd v Rossato [2020] FCAFC 84 has ruled a casual coal-mining worker who was engaged on six consecutive employment contracts over a four-year period was in fact a permanent employee and entitled to paid leave entitlements such as paid annual, personal/carers and compassionate leave.

    Importantly, this case does not mean that all casuals are entitled to paid leave, but that on these particular facts, this employee was found not to be a true casual. Employers who take some sensible precautions can potentially avoid this risk with regard to their casuals.

    In 2017, it was announced that the Centre for Automotive Safety Research (CASR) was preparing recommendations for a Graduated Licencing Scheme for motorcyclists in South Australia. The report was published in January 2018. Recommendations from CASR included raising the minimum age that a rider can obtain their motorcycle learner’s permit from 16 to 18 years old and including the need for moped (scooters under 50cc) riders to be licenced.

    ATV Safety - Coroners' evidence ignored

    Recent recommendations with the aim of improving ATV safety handed down at three separate and independent Coronial Inquests have gone unheard interstate. Following the findings into several ATV fatalities over a period of five years, the Tasmanian Coroner noted that none of the riders tragically killed received formal ATV-rider training and consequently recommended mandating training for all riders.

    460 defect notices issued to motorists during police blitz

    A recent safety blitz on Adelaide roads has revealed an alarming number of unroadworthy vehicles currently being driven, with some drivers were aware their vehicle was defectable.

    Out of the 460 defect notices issued, 29 motorists were cautioned for breaching vehicle standards and 16 were issued with expiation notices for driving contrary to a defect notice or breaching vehicle safety standards.
