Sadly, there have been a number of incidents recently where workers have been either seriously injured or killed in accidents involving forklifts.

In the first incident, a worker was seriously injured while carrying out maintenance work on a forklift. The carriage and tines were raised and were not supported. They fell, striking and trapping the worker.

The Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 was recently passed which has introduced new sexual harassment laws. These laws are designed to prevent sexual harassment in the workplace and provide better protection for victims. We are thrilled to announce that the MTA has been approved to deliver the AUR32721 - Certificate III in Automotive Electric Vehicle Technology. As of now, the MTA is the only Registered Training Organisation (RTO) in South Australia authorised to provide this certification.

The Federal Government has passed a new bill which will replace the existing laws around family and domestic violence leave. Employees will be entitled to 10 days of paid family and domestic violence leave. This leave will be paid for by employers and will be available to full-time, part-time and casual workers.

On 22 December 2022, the Fair Work Commission handed down a decision relating to the shutdown provisions in a number of modern Awards. This decision, which will come into effect on 1 May 2023, will affect 78 modern Awards, including core Industry Awards of MTA members such as the Vehicle Repair Services and Retail Award 2020, Road Transport and Distribution Award 2020 and Clerks Private Sector Award 2020.

Directors fined and charged as regulator issues warning on "off-the-shelf" safety systems

In one of the biggest shake-ups in the industrial relations sphere since the introduction of the Fair Work Act in 2009, the Federal Government have introduced to Parliament an omnibus Bill making wide-sweeping changes to a number of key areas of concern for both employers and employees.

The Fair Work Commission's foreshadowed Wage and Allowance Determinations for the Vehicle Repair, Service and Retail Award 2020 was released Friday 29 January 2021 and became effective as of Monday 1 February 2021 and will need to be applied in the next full pay period.

Just as the Morrison Government's Omnibus IR Bill says a casual will be defined on the basis of their job offer, rather than subsequent conduct, the labour hire company at the centre of a landmark casuals case has told the High Court employment contracts must be decisive.

In a case likely to strike a chord with employers considering compulsory COVID-19 vaccines for employees, especially in certain industries, a worker has been permitted to pursue a claim that her employer unfairly dismissed her by placing her on indefinite unpaid leave for declining to receive a flu vaccination, which the employer mandated for the COVID-19 pandemic.

The imminent release of COVID-19 vaccines in Australia will bring new challenges for employers, but determining whether vaccinations can be mandated in specific workplaces will require the same "reasonable and necessary" test as other workplace safety requirements.

The MTA and the Department for Industry and Skills working together to reinstate Designated Area Migration Agreements (DAMA), after the removal of six automotive occupations in late 2020. Safe Work Australia has released Australia's "first comprehensive WHS guidance" on preventing workplace sexual harassment, acting on a national inquiry's recommendations to produce the document and drive home the message that sexual harassment is a major work health and safety issue.

Following two recent decisions against them in the Federal Court, labour hire company Workpac has sought special leave to appeal to the High Court following last month's momentous Rossato decision, which paved the way for casuals to claim leave entitlements. A ruling employers now estimate could expose them to more than $14 billion in back-pay.

Increasingly, the fundamental issue in these cases is less about whether there was a valid reason for termination, and more about the process undertaken leading to termination. This aligns with the reporting of decisions from the Fair Work Commission, where many applicants succeed, despite the Commission finding there was a valid reason for termination, because the employer failed to allow procedural fairness.

The MTA is disappointed in today’s announcement that the State Government has been unable to award a tender for Stage Two of the Heavy Vehicle Inspection Scheme (HVIS).

During the COVID-19 crisis, WH&S obligations continue to apply. Risk assessment and management should continue, with a focus on managing COVI-19 hygiene and distancing requirements. The primary duty remains in place, to ensure, so far as is reasonably practicable, that the health and safety of workers, clients, visitors, customers and volunteers in the workplace is not put at risk from the conduct of the business or undertaking.

If an employee falls sick with COVID-19, then a claim may arise under worker’s compensation if the illness was contracted arising from or in the course of employment. If the employee is treated as an in-patient in hospital for any duration, then the incident may also need to be reported to SafeWork SA or WorkSafe NT.

As the COVID-19 crisis begins to ease and lose some urgency, employees are beginning to question actions taken by employers around flexible work arrangements, under by agreement, under the Fair Work Act, under JobKeeper, or under Award variations.

Push back from employees includes refusing to attend work when directed, seeking to stay at home on JobKeeper, or seeking their annual leave to be restored where taken by agreement or direction.

The Full Federal Court in the case of WorkPac Pty Ltd v Rossato [2020] FCAFC 84 has ruled a casual coal-mining worker who was engaged on six consecutive employment contracts over a four-year period was in fact a permanent employee and entitled to paid leave entitlements such as paid annual, personal/carers and compassionate leave.

Importantly, this case does not mean that all casuals are entitled to paid leave, but that on these particular facts, this employee was found not to be a true casual. Employers who take some sensible precautions can potentially avoid this risk with regard to their casuals.

In 2017, it was announced that the Centre for Automotive Safety Research (CASR) was preparing recommendations for a Graduated Licencing Scheme for motorcyclists in South Australia.
